Does Your Debtor Have a Job?
By "job" we mean is your debtor "employed" because if so this is definitely one of the best options for enforcement.
Points To Watch Out For:
Before you opt for this Track please consider if any of the following apply to you situation:
Your debtor must be "employed" - an Attachment of Earnings Order can't be made against a judgment debtor who is self-employed or unemployed - so we need to do some homework on whether the debtor is working and therefore "employed"
Conditions apply if your judgment debtor falls into the category of "serviceman or woman" so if your debtor is in the army, navy or air force or a merchant seaman, this Track cannot be used |
You can't apply for an Attachment of Earnings Order against a limited company or a firm or partnership but you can apply for an Order against a director of the company who is receiving a salary - and who is therefore employed.
